Course Objectives This class aims to: • Develop knowledge and abilities of students on individual application to Constitutional Court which is a recently introduced and an effective remedy for protecting fundamental rights and freedoms; • Teach the students the legal aspects and conditions of individual application to Constitutional Court; • Develop knowledge of jurisprudence of ECHR which are cited in Constitutional Court judgments • Develop abilities of students to fulfill the requirements of making individual application to Constitutional Court
Course Learning Outcomes The students who succeeded in this course;
  • Students, develop abilities to accommodate theoretical knowledge of human rights with legal and judicial practice
  • Students gain knowledge of individual application procedure
  • Students develop skills to affiliate those rights recognized in the Constitution with the rights encapsulated in European Convention on Human Rights
  • Students gain legal knowledge about the enforcement of Constitutional Court judgments regarding individual application
Course Content The constitutional complaint (individual application to Constitutional Court) in comparative perspective; the provisions of the Constitution and Law on Constitutional Court, internal regulations of the Constitutional Court; rules on admissibility criteria; the types of decisions of the Constitutional Court and the enforcement of those judgements; some specific rights such as freedom of expression, personal liberty and security, right to respect for private life etc.
