Course Objectives This course aims to: • Develop knowledge and abilities of students on individual application to Constitutional Court which is a recently introduced and an effective remedy for protecting fundamental rights and freedoms; • Teach the students the legal aspects and conditions of individual application to Constitutional Court; • Develop abilities of students to fulfill the requirements of making individual application to Constitutional Court.
Course Learning Outcomes The students who succeeded in this course;
  • • Gain knowledge of individual application procedure;
  • • Develop abilities to accommodate theoretical knowledge of human rights with legal and judicial practice;
  • • Develop skills to affiliate those rights recognized in the Constitution with the rights encapsulated in European Convention on Human Rights;
  • • Gain legal knowledge about the enforcement of Constitutional Court judgments regarding individual application
Course Content Conceptual framework concerning individual application;definition and specification of individual application in the light of litigation theories; comparative aspect of constitutional complaint (individual application to Constitutional Court);the provisions of the Constitution and ?Code on Establishment and Rules of Procedures of the Constitutional Court?and Internal Regulations of the Constitutional Court; rules on admissibility criteria; the types of decisions of the Constitutional Court
